[7] 6 - Possession of a Controlled Substance

A controlled substance is generally a drug or chemical whose manufacture, possession and use is regulated, such as illicitly used drugs or prescription medications that are designated by law.

This code categorizes controlled substances into two categories: Prescription Substances and Illicit Substances.

Prescription Substances

Prescription Substances may only be possessed and/or handled by the following persons:

• "Medical Employees" including Emergency Medical Technicians, Paramedics, Doctors, Nurses, Pharmacists, Pharmaceutical Technicians, and medically trained police officers\ (\special allowance of Epinephrine, IVS, Morphine, Tranexamic Acid, and Midazolam). Medical Employees may only possess prescription substances for the purpose of performing medical treatment on patients. Medical Employees may not possess prescription substances for the purpose of administering it to themselves or providing it to a non-medical employee without a prescription.
• "Individuals" including persons with medical prescriptions issued to them by a doctor or nurse for a specific medication. Individuals who possess prescription substances must also possess the prescription itself (typically located on a form or on a prescription bottle/container).

List of Prescription Substances

Hydromorphone (Dilaudid®), methadone (Dolophine®), meperidine (Demerol®), oxycodone (OxyContin®, Percocet®), and fentanyl (Sublimaze®, Duragesic®), morphine, opium, codeine, hydrocodone, amphetamine (Dexedrine®, Adderall®), methamphetamine (Desoxyn®), methylphenidate (Ritalin®, Concerta®), amobarbital, glutethimide, and pentobarbital, marijuana (cannabis / "pot/weed"), Codeine®, buprenorphine (Suboxone®), benzphetamine (Didrex®), phendimetrazine, ketamine, Depo®-Testosterone, alprazolam (Xanax®), carisoprodol (Soma®), clonazepam (Klonopin®), clorazepate (Tranxene®), diazepam (Valium®), lorazepam (Ativan®), midazolam (Versed®), temazepam (Restoril®), triazolam (Halcion®), Robitussin AC®, ezogabine, bupropion, trazodone (Desyrel), ondansetron (Zofran®), hydroxyzine (Atarax®), Zolpidem (Ambien®), trenbolone, oxymetholone, methandrostenolone, nandrolone, stanozolol, boldenone, and oxandrolone, cocaine (coke/crack), chlorodiazepoxide (Librium®), eszopiclone (Lunesta®), zaleplon (Sonata®), Gamma-hydroxybutyrate or sodium oxybate (Xyrem®), Flunitrazepam (Rohypnol®), Atomoxetine (Strattera®), Tranexamic Acid, Intravenous Solutions (IVS) (0.9% Normal Saline / NS / 0.9NaCl / or NSS ; Dextrose 5% in Water / D5 or D5W / intravenous sugar solution ; Lactated Ringers / LR / Ringers Lactate or RL ; 0.45% Normal Saline / Half Normal Saline / 0.45NaCl / .45NS).

Cannabis Regulation and Licensing

Section I — Personal Possession

Adults twenty-one (21) years of age or older may lawfully possess cannabis for personal use subject to the following limitations:

• Up to 3 ounces (approximately 85 grams) of cannabis flower; and
• Up to 24 grams of concentrated cannabis, including oils, vape cartridges, extracts, concentrates, or infused edible products.
• Possession within these limits by an adult shall not constitute a criminal offense.
• Persons under twenty-one (21) years of age remain prohibited from possessing cannabis unless authorized under a valid medical prescription.
• Possession in excess of these limits remains unlawful unless authorized under a state-issued commercial cannabis license.
• Nothing in this section authorizes the possession of cannabis with the intent to sell, distribute, or otherwise transfer cannabis for compensation without a valid state-issued license.

Section II — Home Storage

• Adults twenty-one (21) years of age or older may store up to five (5) pounds of cannabis within their private residence.
• Cannabis stored in excess of this limit shall constitute unlawful possession unless possessed pursuant to a commercial cannabis license.

Section III — Home Cultivation

Adults twenty-one (21) years of age or older may cultivate:

• Up to six (6) cannabis plants per individual; or
• No more than twelve (12) cannabis plants per household regardless of the number of occupants.
• Plants exceeding these limits are unlawful unless cultivated pursuant to a state-issued cultivation license.

Section IV — Consumption

Cannabis may be consumed:

• Within a private residence;
• In any public location where cigarette smoking is otherwise lawfully permitted.

Cannabis consumption remains prohibited:

• Inside any motor vehicle;
• On school property;
• On federal property;
• In any location where smoking or public drug consumption is otherwise prohibited by law.

Section V — Licensed Cannabis Businesses

The State of San Andreas shall establish a licensing system authorizing qualified persons or entities to operate cannabis businesses.

Licenses may include:

• Retail Cannabis Dispensaries
• Cannabis Cultivation Facilities
• Cannabis Processing Facilities
• Cannabis Distribution Operations

Licensed businesses shall:

• Obtain and maintain a valid state operating license.
• Comply with all applicable health and safety regulations.
• Submit to inspections by authorized state agencies.
• Maintain accurate inventory and sales records.
• Remit all required licensing fees and taxes.
• Operating any cannabis business without the required state license remains unlawful.

Section VI — Commercial Regulation

The State shall establish regulations governing:

• Packaging and labeling;
• Product testing;
• Quality assurance standards;
• Inventory and sales tracking;
• Licensing requirements;
• Tax collection.

Revenue generated through licensing fees and cannabis taxation may be allocated to public safety, emergency services, transportation infrastructure, healthcare, education, and community development.

Illicit Substances

Illicit Substances may not be possessed by any person.

Heroin, lysergic acid diethylamide (LSD), peyote (Mescaline), Quaaludes (methaqualone), methylenedioxymethamphetamine ("Ecstasy"), PCP/Angel Dust (phencyclidine), psilocybin, salvia, ayahuasca, Synthetic Cannabinoids (K2/Spice), Synthetic Cathinones (Bath Salts/Flakka), Psilocybin (Magic Mushrooms/Shrooms)
