Introduction

The laws and statutes that comprise this document are not open to interpretation by the public. They are to be read literally. Interpretation is reserved for the courts.

The Department of Justice is hereby formed to establish systems for enforcing laws, seeking just punishment for those found guilty of crimes, and to ensure the fair and impartial handling of justice. The State of San Andreas has one governing body, being the United States Federal Government. As such, all government entities or agencies that fall under the Federal Government are.

  • Department of Homeland Security
  • Federal Aviation Administration

In accordance with the departments established above, any document, identification, building, employed persons, vehicles, or property belonging to or distributed by these departments/entities are considered federal.

The Government Board of Directors is hereby formed to direct the creation, alteration, and enforcement of these laws.

Citing the Code

For consistency and to allow ease of understanding, please refer to penal code entries in one of three ways:

  • With the full title, prefix first. For example, [1] 1 - Vehicle Manslaughter.
  • With the prefix. For example, [1] 1 or [1] 2.
  • [#] may also be cited by Title and Section. For example, [1] 1 may be cited as Title 1, Section 1.

Life Sentence Determination

A life sentence may be imposed in one of the following ways.

1. Single Arrest Life Sentence

If the total calculated jail time for a single arrest is equal to or greater than 2000 seconds, the character is considered incarcerated for life, regardless of prior history.

2. Three Strikes System (Violent Felonies)

A life sentence may also be imposed through the accumulation of violent felony strikes across multiple arrests.

Only charges classified as Violent Felony Strikes count toward accumulation. Misdemeanors and non-violent felonies do not apply. The strike system does not modify sentencing times for individual arrests. It only determines eligibility for life imprisonment once three strikes have been reached.

Violent felony strikes accumulate across multiple arrests.

Strike System

  • First Violent Felony Strike — Standard sentencing applies.
  • Second Violent Felony Strike — Standard sentencing applies.
  • Third Violent Felony Strike — The offender shall be sentenced to Life Imprisonment.

Violent Felony Strike Classification

The following charges qualify as Violent Felony Strikes due to the intentional use or attempted use of force against another person, severe coercion, or conduct demonstrating extreme disregard for human life that creates a substantial risk of serious bodily harm or death to civilians or law enforcement.

  • [2] 17 – Aggravated Battery
  • [2] 19 – Killing or Injuring a Police Animal
  • [2] 21 – Armed Robbery
  • [2] 22 – Human Trafficking (Federal Charge)
  • [3] 27 – Reckless Evading

3. Life Sentence Documentation

When a life sentence is imposed, the arrest report must clearly document the reason for the life sentence. The first line of the notes within the arrest report must state one of the following:

Use one of the following exactly as written:
LIFE SENTENCE – 2000 SECOND THRESHOLD
OR
LIFE SENTENCE – THREE STRIKE RULE

This is a two-part disclaimer.

The first disclaimer is that several offenses that would commonly be illegal in developed western nations are intentionally not included within this code because they are against the rules of this community in some way, shape, or form.

This particularly applies to "sex crimes." "Sexual RP" is not permitted here and therefore crimes including rape, prostitution/pimping, sexual assault/battery, sex crimes against minors, etc. are intentionally left out of this penal code. The absolute maximum amount of relevant RP of this kind you may perform here would be exemplified by the Domestic Violence law, the "sexual remarks or physical advances" portion of the Sexual Harassment law, or the "act of intentionally touching another person without consent" portion of the Simple Battery law.

The second disclaimer is that just because an offense is listed in the penal code does not mean anyone is allowed to do it. The rules page contains a list of restricted roleplay scenarios which place limitations onto certain higher crimes such as, but not limited to, terrorism, bank robbery, etc.
