Possession of a Class 1, 2, 3, or 4 weapon, weapon accessory, disassembled kits of the below, or device.

Additionally, all firearms require serial numbers to be associated and registered with the NCIC/CAD. Altering, removing, or possessing a firearm without an associated valid serial number is an offense under this code and is to be charged under the class 1 weapon sentence.

Class 1

  • Silencers
  • Suppressors
  • Bump Stocks

Class 2

  • Automatic weapons
  • Machine guns
  • Short-barreled shotgun
  • Short-barreled rifle

Exception: Class 2 weapons may be possessed/owned by a licensed gun store. Class 2 weapons may not be sold. If the gun store has a certified gun range, the weapon may be fired.

Class 3

  • Explosive Devices
  • Improvised Explosive Devices
  • Grenades
  • Pipe Bombs
  • Missiles
  • Rockets
  • Large-caliber Projectile weapons launchers
  • Class 3 weapons may be prosecuted as either a regular or federal offence, but not both.

Class 4

  • Incendiary Ammunition
  • Explosive Ammunition
  • Armor Piercing Ammunition

Class 4 weapons may be prosecuted as either a regular or federal offence, but not both.

Violation of this is a Felony Class 1 Weapon Sentence: 150 Seconds
Class 2 Weapon Sentence: 300 Seconds
Class 3 4 Weapon Sentence: 500 Seconds
If disassembled and not attached to the firearm, but listed above (such as a weapon modification kit), the charge shall resemble the penalization of the same category that the kit content contains.
Wobbler This offence is a wobbler charge. This means that it may be either a Federal Charge or a Regular Charge depending on the nature of the crime, as specified above.
