Any person found to be in possession of a firearm, weapon, or explosive, regardless of past criminal record or license to carry, who fails to declare the presence of their weapon on their person or in their vehicle immediately after being contacted by a law enforcement officer. This does not apply to weapons that are clearly visible such as those that are being openly carried.

Examples:
• Individual does not declare any of the listed above when on a traffic stop.
• Individual does not declare any of the listed above when being searched.
